Terms and Conditions for Occupational Therapy Services

This website and associated services are owned and operated by Jakk Walsh OT (Jakk Walsh, ABN 43 493 347 140). Related entity: The Trustee for J Walsh Family Trust (ABN 63 105 947 184).

By booking an appointment or engaging services with Jakk Walsh OT, you agree to these Terms and Conditions ("Terms"). These Terms form a binding agreement.  We may update these Terms; continued use constitutes acceptance.

1. Cancellations and Credits Your Cancellations:

• If you cancel your appointment with more than 24 hours notice, there will be no charge.

• Less than 24 hours' notice or no-show: 100% of the appointment fee charged.

• To cancel or reschedule, contact us as soon as possible at jakkwalsh.ot@gmail.com to notify us and free up the slot for others.

• We may waive fees at our sole discretion in exceptional circumstances (e.g., verified medical emergencies with documentation).

• Our Cancellations: If we need to cancel or reschedule (e.g., due to illness or technical issues), we will offer a full refund of prepaid fees, a credit for future services, or rescheduling. We are not responsible for any other costs or losses (e.g., travel expenses or lost time).

• Refunds will be processed within 14 days. No refunds for completed services or change of mind, except as required by Australian Consumer Law (ACL).

2. Services

We provide evidence-based occupational therapy as a registered Occupational Therapist with the Occupational Therapy Board of Australia (OTA) and the Australian Health Practitioner Regulation Agency (AHPRA). Services include assessment, intervention, education and reports, delivered in line with professional standards. All sessions are conducted in person unless otherwise arranged.

Occupational Therapy supports everyday function, participation and independence. It is not a medical diagnosis or a substitute for medical care. Please see a doctor for medical concerns. No particular outcome is guaranteed; progress depends on individual circumstances, engagement and the supports available at home, school and in the community.

3. Bookings

No referral is needed to book. Provide accurate information (e.g., health history, referrals). To prepare for your initial session, please email any relevant medical documents (e.g., test results or professional notes, as well as a signed copy of the supplied service agreement to jakkwalsh.ot@gmail.com at least 24 hours prior for optimal service. Bookings are confirmed via text or email prior to the session. We may cancel or reschedule with notice.

• For telehealth: You consent to electronic delivery and must ensure a secure setup (device, internet, private space). Risks include technical failures; we use encrypted tools but cannot guarantee absolute security.

• Clients aged 18 and over: You may book and attend independently.

• Clients under 18 (minors): Parental or legal guardian consent is required.

4. Fees and Payments

Fees are shown at the time of booking and are charged at the agreed occupational therapy rate, up to the applicable NDIS price limit where the service is NDIS-funded.

NDIS-funded supports that form part of a participant’s plan are generally GST-free when billed in line with GST and NDIS rules. Any privately funded services will be billed as agreed, including GST if it applies.

Payment is not required upfront. After the service is delivered, our bookkeeper will invoice the participant’s plan representative (for example, the plan manager, nominee or self-managed participant) for the completed session or report.

You (or your plan representative) remain responsible for:

• confirming that funding is available in the correct NDIS budget

• providing current plan-manager or billing details

• paying any amount not covered by NDIS funding

If Medicare, private health or other rebates ever apply, you are responsible for checking eligibility and completing any required paperwork. We can provide invoices and receipts to support a claim. You are responsible for any gap.

Fees already invoiced for services delivered are payable in full. Refunds are only made as set out in the cancellation policy or as required by the Australian Consumer Law.

5. Privacy and Consent

We comply with the Privacy Act 1988, Australian Privacy Principles (APPs), and state health records laws. Our Privacy Policy is available upon request at jakkwalsh.ot@gmail.com. You consent to:

• Secure storage of your data.

• Disclosure to your healthcare team when needed.

• Anonymised use for research or education.

You may withdraw consent anytime (subject to law). Records are retained for at least 7 years (or until age 25 for minors). We are not liable for external data breaches but will notify you as required.

6. Your Responsibilities

Provide accurate and complete information, including referral sources. Attend prepared and follow instructions. Respect our staff; abusive behaviour may result in service termination without refund. Seek medical advice as needed.

7. Standards and Disclaimers

We follow the OTA Code of Conduct for ethical practice. Advice is supplementary; we are not liable for misuse or third-party services.

8. Liability and Indemnity

To the maximum extent permitted by law (including ACL), we exclude liability for any losses (direct, indirect, or consequential) arising from our services, including outcomes, reliance on advice, or force majeure events. Our liability is limited to the fee paid. You indemnify us against claims arising from your breach, inaccurate information, or related actions.

9. Complaints

Contact us first at jakkwalsh.ot@gmail.com. If unresolved, escalate to Occupational Therapy Australia (OTA) or Australian Health Practitioner Regulation Agency (AHPRA). Keep disputes confidential; breaches may lead to legal action.

10. General

These Terms are governed by the laws of Victoria, Melbourne, Australia.

Amendment of Terms

We reserve the right to change, modify, add, or remove portions of these Terms at any time. Please check these Terms regularly prior to using our services or website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. Your continued use constitutes acceptance.
